TIME LIMITS TO FILE A LAWSUIT IN HOUSTON TEXAS
Under Texas law with regards to construction defects you must make it claim timely. That means that certain notices must be given under the UCC and common law statutes and a lawsuit must be filed within a certain time period.
Under the statute of repose you must make a claim within 10 years of substantial completion of the project. The easiest way to determine substantial completion is to look at the certificate of occupancy given by the local government entity.
If you are injured or have a DTPA claim because of a Houston construction defect then you have 2 years from the date of the injury. One situation would be where a defect not known caused your injury like a faulty line installation to make a fire or explosion, or a line was punctured by a third party that was never seen which could be DTPA claim.
The statute of limitations allows four years from discovery of the defect. If you realized that there is an issue with the plumbing lines, for example, you need to let the courts and homebuilder know of the issue or you waive the issue and the time to file suit.
